If the parties have a month-to-month rental agreement in San Francisco or Oakland, how can a landlord change the terms of that agreement? In order to change the terms of a rental agreement, a landlord must give written notice to the tenant and the notice must be properly served on the tenant. Now, there are basically two types of changes to terms of the tenancy, rent increases and all other changes to the terms of the tenancy. For rent increase notices of 10% or less, the landlord needs to give at least 30 days' notice of the change. For rent increases over 10%, the landlord's required to give at least 60 days' notice of the change. For all other changes to the terms of the tenancy, the landlord needs to give at least 30 days' notice to the tenant of the change in the terms, and if the tenant stays in possession of the property, the change in terms of the tendency will take effect.
